JUSTICE ANOOP KUMAR DHAND Order 13/07/2022 Corpus is brought by Mr. Shivlehri, Police Inspector, SHO and F.C. Ms. Niketa F.C. 2585 of Police Station Pahadi from Balikagrah, Gandhi Nagar, Jaipur and produced before this Court.
This Court vide order dated 30.06.2022 ordered to send corpus in Balikagrah, Gandhi Nagar, Jaipur keeping in view her age as reflected in the School Transfer Certificate.
We have heard learned counsel for the petitioner and the learned counsel appearing for the contesting respondent No. 7 for some time.
Both the counsel are raising disputed questions of fact before this Court. They wish to rely upon the judgments of other High Courts and the Hon'ble Supreme Court. (Downloaded on 20/07/2022 at 09:34:01 PM)
(2 of 2) [HC-139/2022] It will be open for them to exchange each other compilation of the judgments on which they wish to place reliance on the next date.
On the joint request, list the matter on 22.07.2022. Corpus be taken back to Balikagrah, Gandhi Nagar, Jaipur. At this stage, counsel appearing for the contesting respondent No.7 submits that FIR has been registered against respondent No.7. Counsel further submits that the respondent No.7 was on transit bail and applying for regular bail after his surrender.
We clarify that pendency of this petition cannot be construed as an impediment by the concerned court to consider the application for bail, filed, if any, in future by the respondent No. 7 on its own merit and in accordance with law.
The interim order passed by this Court on 30.06.2022 to continue until further orders.
