JUSTICE SUDESH BANSAL Order 08/07/2022 All three appeals arises against judgment and decree dated 18.10.2004 passed by Additional District Judge No.5, Jaipur City, Jaipur in Civil Suit No.98/1998 whereby respondents-claimants have been awarded a compensation of Rs.3,77,000/- on account of death of their husband/father (bread earner). (2 of 2) [CFA-28/2005] It has been informed that in all three appeals, appellants have deposited 1/3rd- 1/3rd share of compensation amount which is laying deposited in FDRs.
It has been submitted that respondents-claimants have not received any amount out of awarded compensation as they could not furnish bank guarantee. Respondents-claimants have moved an application (No.1/2022) with a prayer to disburse the compensation amount in all three appeals. A copy of application be supplied to respective counsel appearing for appellants.
List these appeals again on 20.07.2022 in supplementary list.
In the meanwhile, respondents-claimants are at liberty to furnish affidavit explaining circumstances for not able to furnish the bank guarantee.
