HON'BLE MR. JUSTICE SAMEER JAIN Order 01/12/2022 By way of the present petition, learned counsel for the Revenue has sought to review under Order 47 of CPC read with Section 151 for reviewing/recalling the order dated 07.07.2017.
On a perusal of the said judgment, it is analyzed that the Co-ordinate Bench, has held that once the tax imposed is not being challenged, the issue of interest does not survive.
Therefore, the present review petition is filed merely to abuse the process of the Court, without any substance or merits.
Accordingly, the Review Petition is dismissed.
