HON'BLE MR. JUSTICE SUDESH BANSAL Order 01/08/2022 This appeal has been filed by and on behalf of Ajmer Vidyut Vitran Nigam Limited (hereafter 'the AVVNL') assailing the judgment and award dated 27.01.2022 passed by Additional District and Sessions Judge, Kishangarh (Ajmer) in civil suit No.11/2016 (CIS No.13/2016) whereby the suit filed by respondent-plaintiffs for compensation under the provisions of Fatal Accident Act has been allowed.
Heard.
Admit.
Issue notice.
In case appellant-AVVNL deposits entire amount of compensation along with interest within a period of eight weeks before the trial court, execution of impugned compensation relating to present claim petition is concerned shall remain stayed.
Out of compensation amount so deposited, 50% amount be disbursed to respondent-plaintiffs through saving bank account to (Downloaded on 03/08/2022 at 09:54:32 PM) (2 of 2) [CFA-215/2022] be furnished by respondent-plaintiffs. Remaining 50% amount shall remain deposited in FDR, in a nationalised bank initially for a period of three years subject to renewal from time to time.
The trial court after completing the proceedings of deposition and disbursement of compensation amount, as mentioned above, shall send the record to this Court.
