It has been submitted on behalf of the appellant that the appellant has filed this appeal against the judgment dated 09.08.2019 by which the learned trial court acquitted the accused. The delay was caused as the appellant is an illiterate and poor lady and financial condition of the appellant is very weak, therefore, she could not afford advocate due to poor financial financial conditions. Thereafter from the month of March 2020, there was lock-down due to COVID-19, the appellant could not approach to her counsel due to lock-down during that period. Delay in filing the appeal is bona fide.
In view of the submissions, the application under Section 5 of the Limitation Act is allowed. Delay in filing the appeal is condoned.
