----Respondents
For Petitioner(s) : Ms. Kripa Kumari Gurjar For State : Mr. Shyam Prakash Sharma, PP HON'BLE MR. JUSTICE PANKAJ BHANDARI Judgment / Order 08/11/2021
1. Petitioners have preferred this criminal misc. petition under Section 482 Cr.P.C. seeking protection against Respondents No.6 &
7. (Downloaded on 11/11/2021 at 08:52:03 PM)
(2 of 2) [CRLMP-7084/2021]
2. It is contended by counsel for the petitioner that petitioners' son was married to the daughter of Respondent No.7. Respondent No.7 concealed the fact of prior marriage of her daughter and after concealing the said fact, got her daughter married to petitioners' son. When this fact came to the notice of petitioners, they talked to Respondent No.7, but she in turn threatened the petitioners. It is further contended that petitioners have filed a criminal complainant and a complaint to the S.H.O., Police Station Bajaj Nagar, Jaipur.
3. I have considered the contentions and have perused the complaint as well as the report which was sent to the Police Station, Bajaj Nagar, Jaipur.
4. From perusal of the complaint and the said report, there appears to be a matrimonial dispute between the son of petitioners and the daughter of Respondent No.7. As such, there is no allegation with regard to threat of life or liberty. The proper course available to the petitioners is to approach the concerned Magistrate, where they have filed the complaint. The petition is wholly frivolous and misconceived, hence, misc. petition is dismissed.
5. Accordingly, Criminal Misc. Petition is dismissed. Stay application also stands disposed of.
