JUSTICE SAMEER JAIN Order 29/11/2021 The Registry has tagged the file of S.B. Criminal Appeal No.411/2002 (Madan Singh Vs. State) with this parole writ petition in compliance of the order dated 22.11.2021. A perusal of the judgment dated 15.04.2002 rendered by the trial court in Sessions Case No.85/2001 indicates that the appellant herein was also convicted in the said case for the offences punishable under Sections 302 read with Section 34 and 120B, 397 and 201 IPC. A perusal of the judgment also indicates that two accused Mehrudeen and Arjun Lal, were reported to be absconding. Learned Public Prosecutor shall take up this issue with the police (Downloaded on 29/11/2021 at 08:58:15 PM) (2 of 2) [CRLW-307/2020] officers concerned. The Registry shall als take a report from the trial court in this regard.

Learned counsel for the petitioner prays for time to satisfy the Court that despite being sentenced to life imprisonments in two cases, the petitioner is entitled to permanent parole even though as per the case of the respondents, the convict has not earned eligibility for being released on permanent parole because after conviction of the petitioner in the present case, he was again convicted to life imprisonment in Sessions Case No.91/2001. As per the respondents, the sentences awarded to the appellant in the two cases would run one after the other and hence, the appellant is not entitled to be released on permanent parole as he has not earned the eligibility criterion so far. Copies of both the judgments (Sessions Case No.85/2001 and 91/2001) shall be provided to learned counsel Ms. Ramawat.
