JUSTICE VIJAY BISHNOI Judgment / Order 03/05/2021 Heard learned counsel for the petitioners as well as learned Public Prosecutor and also perused the material on record.

The petitioners have been arrested in FIR No.19/2021 of Police Station Chitalwana, District Jalore for the offences punishable under Sections 8/22, 29 of NDPS Act. They have preferred these bail applications under Section 439 Cr.P.C. (Downloaded on 07/05/2021 at 08:15:06 PM)

(2 of 2) [CRLMB-5185/2021] Learned counsel for the petitioners has submitted that after rejection of the first bail application of the petitioners, charge sheet has been filed against them. It is further submitted that the tablets containing narcotic substance Tramadol alleged to have been recovered in the case are below commercial quantity as the total weight of the recovered tablets is 154 gms without strip and with strip, the same comes to 209 gms whereas upto 250 gms of narcotic substance Tramadol is considered to be below commercial quantity.

Learned Public Prosecutor has opposed the bail applications. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, these bail applications filed under Section 439 Cr.P.C. are allowed and it is directed that petitioners Manoj Kumar S/o Madanlal and Chokha Ram S/o Arjun Ram shall be released on bail in connection with FIR No.19/2021 of Police Station Chitalwana, District Jalore provided each of them executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
