1. Petitioners have filed this bail application under Section 438 of Cr.P.C.
2. F.I.R. No.203/2020 was registered at Police Station, Malpura, District Tonk (Raj.) for offence under Sections 143, 447, 307, 323, 341, 354 I.P.C.
3. It is contended by the counsel for the petitioners that there is cross F.I.R. Earlier F.I.R. was lodged by the petitioner side. It is also contended that Petitioners No.1 & 2 have received injuries, Petitioners No.3 & 4 are not named in the F.I.R. and no overt act is (Downloaded on 11/03/2021 at 08:50:38 PM) (2 of 2) [CRLMB-1789/2021] assigned to the Petitioners No.1 & 2. No custodial interrogation is required in this case.
4. Learned Public Prosecutor has opposed the bail application.
5. I have considered the contentions.
6. Considering the contention put forth by counsel for the petitioners, the anticipatory bail application is allowed.
7. The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Malpura, District Tonk (Raj.) in F.I.R. No. 203/2020 is directed that in the event of arrest of the petitioners they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-
(I). that the petitioners shall make themselves available for interrogation by a police officer as and when required;
(ii). that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and
(iii). that the petitioners shall not leave India without previous permission of the Court.
