1. Petitioner has filed this bail application under Section 439 of Cr.P.C.
2. F.I.R. No. 26/2020 was registered at Police Station Pratap Nagar, Jaipur for offences under Sections 302, 392 & 364-A of I.P.C.
3. It is contended by counsel for the petitioner that petitioner is not a contract killer. Prosecution has produced some CCTV Footage of restaurant where petitioner is seen talking with the husband of the deceased. It is also contended that merely because petitioner was talking with the husband of the deceased does not connect him with the crime. It is further contended that guard has also not (Downloaded on 11/03/2021 at 08:50:08 PM) (2 of 2) [CRLMB-14410/2020] seen the petitioner going into the house of the deceased. It is contended that the FSL Report with regard to the fingerprints is also not matching with that of the petitioner.
4. Learned Public Prosecutor and counsel for the complainant have opposed the bail application. It is contended that petitioner was a friend of co-accused Rohit Tiwari and he in order to help his friend, took some money for committing the offence of murder. It is also contended that as the deceased was known to petitioner, she served him tea. It is further contended that in the CCTV Footage of the neighbouring house, petitioner is seen entering and going out with the child of the deceased. It is contended that petitioner has committed double murder.
5. I have considered the contentions.
6. Considering the contentions put forth by counsel for the State and counsel for the complainant, I am not inclined to entertain the bail application.
7. This bail application is accordingly, dismissed.
