HON'BLE MR. JUSTICE GOVERDHAN BARDHAR Order 03/03/2021 As per office report, service of notice on all the respondents/plaintiffs is complete.
Till further orders, the effect and operation of the judgment and decree dated 30.07.2018, passed by Court of Additional District Judge, Bansur, District Alwar (Raj.) shall remain stayed subject to the condition the appellants deposit the entire amount under the decree within one month time from today with the Court below.
Upon such deposit being made, the plaintiff- respondents shall be at liberty to withdraw 50% out of the said deposit subject to their furnishing an undertaking before the Court below to the effect that if the appellants/non-claimants ultimately succeed in the appeal, the said amount shall immediately be (Downloaded on 10/03/2021 at 09:12:14 PM) (2 of 2) [CFA-1082/2018] returned and deposited back with interest from the date of withdrawal.
The remaining 50% of the award amount be invested in FDR in a National Bank for a period of one year, which shall be renewed from time to time.
