HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Order 01/03/2021 Learned counsel for the petitioner submits that he has already removed the defect No.1.
Defect No.2 pointed out by the Registry is waived. The writ petition was heard for admission on the request of learned counsel for the petitioner.
By way of this writ petition filed under Article 226 of the Constitution of India, a direction has been sought for the Board of Revenue, Rajasthan, Ajmer (for brevity "the Board") to decide the (Downloaded on 01/03/2021 at 10:30:18 PM) (2 of 2) [CW-5258/2019] Review T.A. Application No.7088/2012, District Karauli, Chothmal versus Thakurji Mandir Govind Dev Ji & Ors., expeditiously.
Learned counsel for the petitioner submitted that the application filed by the respondent No.1 under Order 7 Rule 11 CPC in the Civil Suit filed by the petitioner was dismissed by the learned trial Court vide its order dated 26.12.2002. The revision petition filed thereagainst was also dismissed by the Board vide its judgment dated 02.07.2012; but, the review petition filed by the respondent No.1 against the order rejecting his revision petition is subjudice for last about 9 years. He, therefore, prayed for expeditious disposal of the same.
In view of the limited prayer made by the learned counsel for the petitioner, this Court deems it just and proper to decide this writ petition without issuing notice to the respondents.
In the aforesaid circumstances, the Board is directed to decide the Review T.A. Application No.7088/2012, District Karauli, Chothmal versus Thakurji Mandir Govind Dev Ji & Ors. within a period of six months from the date of receipt of certified copy of this order.
With the aforesaid directions, the writ petition is disposed of.
