(2) Learned counsel appearing for the applicant invited Court's attention towards documents filed with the present bail application and submits that applicant's wife is indisposed and needs treatment.
(3) Learned Public Prosecutor on the other hand submits that the petitioner has took a plea of indisposition of his father before the trial Court and now he has come with a new case that his wife is indisposed for seeking interim bail. (4) Upon consideration of the material available on record and the copies of prescriptions of Smt. Kamla Devi (petitioner's wife), (Downloaded on 07/06/2021 at 08:17:28 PM) (2 of 2) [CRLMB-6906/2021] this Court does not find any serious aliment for which, applicant's prayer for interim bail should be acceded to. (5) The petitioner had moved the bail application before the trial Court claiming that he and his family members were infected with Covid, however, their reports as produced by learned Public Prosecutor (which are taken on record) shows that they are negative.
(6) So far as the ground of ailment of wife is concerned, suffice it to note that applicant has not cared to place on record any documentary evidence evincing any serious aliment of his wife, this Court is not inclined to grant interim bail. (7) Needless to observe that rejection of the present interim bail application will not come in the way of the petitioner for moving fresh bail application, if his wife is in real need of any surgical intervention requiring petitioner's presence.
