1. Defect/s is waived.
2. This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 41/2021 registered with Police Station Piloda, District Sawaimadhopur for offence under Section 19/54 of the Rajasthan Excise Act, 1950.
3. Heard learned counsel for the accused petitioner through video conferencing and perused the record.
4. It has been argued on behalf of the petitioner that he has been falsely implicated in this case. The offence has been registered under Section 19/54 of the Rajasthan Excise Act, 1950. Case is triable by Magistrate Court. The alleged recovery has not been made from the possession of the present petitioner. Decision (Downloaded on 28/06/2021 at 08:41:31 PM) (2 of 2) [CRLMB-10073/2021] of the case will take time. There are no criminal antecedents against the petitioner.
5. Learned Public Prosecutor has opposed the bail application.
6. I have considered the contentions.
7. On consideration of arguments/submissions of both the parties, perusal of material on record, nature of accusations and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused on bail.
8. Therefore, the bail application is allowed. Accused-petitioner Mahaveer S/o Ramprasad shall be released on bail in FIR No. 41/2021 registered with Police Station Piloda, District Sawaimadhopur, if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
