1. Petitioner has filed this second bail application under Section 439 Cr.P.C.

3. It is contended by counsel for the petitioner that petitioner has remained in custody for a period of fifteen months. From the statement of the prosecutrix, it is not revealed that rape was committed.

4. Learned Public Prosecutor has opposed the second bail application. It is contended that prosecutrix is a child. She has stated in her statement that the act was forcefully committed upon her and she was threatened.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the State, I am not inclined to entertain the second bail application.

7. This second bail application is, accordingly, dismissed.
