HON'BLE MR. JUSTICE ASHOK KUMAR GAUR Order 19/07/2021 Learned counsel for the petitioner submitted that the petitioner was allotted House No.7/H/220, Indira Gandhi Nagar, Jagatpura, Jaipur by the Rajasthan Housing Board in the year 2001.

Learned counsel submitted that the allotment in favour of the petitioner was cancelled arbitrarily and as such the petitioner had filed S.B. Civil Writ Petition No.1494/2015 before this Court.

This Court by a common judgment dated 15.02.2017, disposed of the writ petition by remanding the case of the (Downloaded on 20/07/2021 at 09:52:03 PM) (2 of 2) [CW-7583/2021] petitioner and other similarly situated persons and direction was given that a speaking order is required to be passed as why cancellation was done by the Rajasthan Housing Board after allotment made by the Competent Authority.

Learned counsel submitted that the petitioner submitted his representation in response to the said direction given by this Court and now by impugned order dated 18.06.2021, the petitioner has been communicated that the allotment made in favour of the petitioner cannot be revived.

Learned counsel submitted that the impugned order does not communicate any reason further, the direction given by this Court has been flouted by the respondents.

Issue notice of the writ petition as well as stay application, returnable on 02.08.2021. Notices be given 'dasti' if prayed.

In the meantime, if the House No. 7/H/220, Indira Gandhi Nagar, Jagatpura, Jaipur has not been allotted to any other person till date, the same shall not be allotted to any other person.
