HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Judgment / Order 29/07/2021 This bail application under Sec.439 CrPC has been filed by the petitioners in connection with FIR No.152/2021 registered at Police Station Sadulshehar, District Sri Ganganagar for offence under Section 8/21 of the NDPS Act.
Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
Taking into consideration the amount of the 22 grams Heroin recovered from both the petitioners, which is much less than the commercial quantity, without commenting on merits of the case, I am inclined to grant bail to the petitioners.
Therefore, this bail application is allowed and it is ordered that the accused petitioner - 1) Suraj Dhariwal s/o Jogendra, (Downloaded on 29/07/2021 at 08:58:18 PM) (2 of 2) [CRLMB-9808/2021]
2) Puja w/o Suraj Dhariwal be released on bail under Section 439 CrPC in connection with aforesaid FIR provided each of the petitioners furnishes a personal bond of Rs.20,000/- with one surety in the like amount each, to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Sec.473 (3) CrPC.
