JUSTICE MANOJ KUMAR GARG Order 29/07/2021 The first application for suspension of sentence filed on behalf of the appellant-applicant was dismissed by this Court vide order dated 12.09.2017. This is a second application for suspension of sentence filed on his behalf.
We have heard and considered the submissions advanced by learned counsel Shri JP Bhardwaj, representing the appellant- applicant and learned Public Prosecutor and gone through the impugned judgment and record.
There is distinct allegation of the prosecution witnesses that the appellant-applicant herein inflicted sword blows to deceased Indra and thereby killed her. The case of the prosecution is based on direct evidence. Thus, considering the nature and gravity of the (Downloaded on 29/07/2021 at 08:59:43 PM) (2 of 2) [SOSA-334/2020] allegations attributed to the appellant-applicant, we are not inclined to suspend the sentence of the appellant-applicant awarded by the trial court during the pendency of the appeal.
Hence, the second application for suspension of sentence is dismissed.
