The convict petitioner Hukum Singh S/o Shri Om Singh has been granted first parole of twenty days by the District Parole Advisory Committee, Jhunjhunu vide order dated 01.06.2021 whereby he has been directed to furnish a personal bond in the sum of Rs.1,00,000/- and two sureties in the like amount as a pre-requisite condition for being released on parole. The instant writ petition has been filed on behalf of the convict-petitioner seeking relaxation/waiver in the condition of furnishing surety bonds in terms of the order of the District Parole Committee on the ground of his poor financial condition. (2 of 2) [CRLW-389/2021] Shri Farzand Ali, AAG has submitted a report of the Office of Superintendent of Police, Jhunjhunu as per which, the financial position of the family of the convict prisoner is poor.

Having regard to the overall facts and circumstances of the case, this Court is not inclined to absolutely waive the condition of furnishing surety bonds as imposed upon the convict-petitioner by the District Parole Advisory Committee, Jhunjhunu while releasing him on first parole of twenty days. However, on humanitarian consideration and looking to the poor financial position of the convict petitioner, as indicated in the report of the Superintendent of Police, Jhunjhunu, it is hereby directed that now the convict- petitioner Hukum Singh S/o Sh. Om Singh shall be released on first parole of twenty days upon furnishing a personal bond in the sum of Rs.1,00,000/- with one sound and solvent surety in the sum of Rs.50,000/- to the satisfaction of the Superintendent Central Jail, Bikaner. He shall mark his attendance at the Police Station Bisau, District Jhunjhunu, every seventh day after his release on parole. The writ petition is disposed of accordingly.
