On the request of the learned counsels for the respective parties, the matter was heard for admission today itself.
Both the learned counsels submit that the issue is no more res integra and is covered by judgment of a co-ordinate bench of this Court in case of Chandra Shekhar Yadav vs. State of Rajasthan & Ors., S.B. Civil Writ Petition No. 7956/2020 with other connected matters dated 29.09.2020 and modified (Downloaded on 04/02/2021 at 10:42:06 PM) (2 of 2) [CW-7123/2020] by the Division Bench in D.B. Special Appeal Writ No. 718/2020 Jitendra Kumar Bairwa & Ors. vs. State of Rajasthan & Ors. with other connected matters vide order dated 28.01.2021.
Accordingly, this writ petition is disposed of with liberty to the petitioner to make representation with the respondents within a period of one week from today which shall be decided by the respondents within a period of 30 days from the date of receipt thereof by speaking order. If the representation is rejected, the petitioner shall be at liberty to take appropriate remedy available under the law.
