HON'BLE MR. JUSTICE VINIT KUMAR MATHUR Order 01/12/2021 Heard learned counsel for the petitioner. Learned counsel for the petitioner submits that three complaints were filed by the complainant under Section 138 of the Negotiable Instruments Act for bouncing of three cheques issued by the petitioner. The period of the offence alleged is within one year. He therefore, submits that the application under Section 219 Cr.P.C. filed by the petitioner has been wrongly rejected by the trial court and the revisional court has erroneously confirmed the order passed by the trial court. Learned counsel relies upon the judgment of this Court in Chand Ratan vs. Roop Chand reported in 2013 (1) RCRD 461 (Raj.).
Issue notice. Issue notice of the stay application also, returnable on 04.01.2022.
