1. Petitioner has filed this second anticipatory bail application under Section 438 of Cr.P.C.

2. F.I.R. No.31/2020 was registered at Police Station, Kapren, District Bundi for offence under Sections 420, 467, 468 I.P.C.

3. It is contended by the counsel for the petitioner that after rejection of the first anticipatory bail application, parties have entered into compromise on 24.06.2021.

4. Counsel for the petitioner has placed reliance on "Ganesh Raj Vs. State of Rajasthan"2005 (3) RCC 1401, wherein it is held that second anticipatory bail application is maintainable on the ground of new circumstances for further development in a case.

5. The fact of parties having entered into compromise is not disputed by counsel for the complainant and has no objection to (Downloaded on 19/08/2021 at 10:10:28 PM) (2 of 2) [CRLMB-13031/2021] grant of anticipatory bail to the petitioner.

6. Learned Public Prosecutor has opposed the second anticipatory bail application.

7. I have considered the contentions.

8. In view of the fact that parties have entered into a compromise and complainant has no objection to grant of anticipatory bail to the petitioner, I deem it proper to entertain the second anticipatory bail application.

9. The Second Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Kapren, District Bundi in F.I.R. No. 31/2020 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:- (I). that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and

(iii). that the petitioner shall not leave India without previous permission of the Court.
