----Respondent
For Appellant(s) : Mr. Anil Mehta, AAG with Mr. Yashodhar Pandey and Ms. Archana HON'BLE THE CHIEF JUSTICE HON'BLE MR. JUSTICE MANOJ KUMAR VYAS Order 16/08/2021
1. Heard Mr. Anil Mehta, learned Additional Advocate General appearing on behalf of the appellant.
2. Perused the application under Section 5 of the Limitation Act. There is delay of 1545 days in filing of the present appeal.
3. Although, it is claimed that the State has filed review to the judgment passed by the Hon'ble Single Judge, directions were issued by the Hon'ble Single Judge on 06.01.2015. The review petition filed by the State came to be dismissed on 08.05.2019. It appears that the review petition numbered as S.B. Writ Misc. Application No.365/2018 itself was filed with substantial delay.
4. Accordingly, we find no merit in the application under Section 5 of the Limitation Act for condoning the delay in filing the appeal. (Downloaded on 18/08/2021 at 09:58:52 PM)
(2 of 2) [SAW-985/2019] Consequently, while rejecting the application under Section 5 of the Limitation Act, the appeal also stands dismissed. (MANOJ KUMAR VYAS),J (INDRAJIT MAHANTY),CJ KAMLESH KUMAR /18 (Downloaded on 18/08/2021 at 09:58:52 PM) Powered by TCPDF (www.tcpdf.org)
