1. Heard on application for suspension of sentence.
2. It is contended by counsel for the appellant that the place of occurrence, as stated by the witness is not tallying with the site plan.
3. Learned Public Prosecutor has opposed the application for suspension of sentence. It is contended that prosecutrix is a child, aged ten years. From her Court statement as well as from the statement of the girl who accompanied her, it is evident that the offence was committed with the prosecutrix by the appellant.
4. I have considered the contentions.
5. No ground is made out for entertaining the application for (Downloaded on 13/08/2021 at 09:25:51 PM) (2 of 2) [SOSA-1592/2019] suspension of sentence as prosecutrix is a child, aged ten years and she has specifically levelled allegations against the appellant.
6. Accordingly, the application for suspension of sentence is dismissed.
