JUSTICE INDERJEET SINGH Order 10/08/2021 By this writ petition, the petitioner has challenged the award dated 04.02.2020 passed by the learned Industrial Tribunal, Kota, whereby, the learned Tribunal directed regularization of the respondent-workman after completion of 10 years of service in view of the judgment passed by the Hon'ble Supreme Court in the matter of Secretary State of Karnatka & Ors. Vs. Umadevi & Ors., reported in 2006(4) SCC 1.

I have perused the record as well as the award dated 04.02.2020 passed by the learned Tribunal.

In the earlier round of litigation, the respondent-workman challenged his termination, which was held illegal by the learned Tribunal vide award dated 12.10.2000 and the writ petition filed by the petitioner against the said award was also dismissed by this (Downloaded on 13/08/2021 at 09:31:33 PM) (2 of 2) [CW-4220/2021] Court vide order dated 17.11.2005, thereafter only the present award has been passed by the learned Tribunal.

In my considered view, no illegality has been committed by the learned Tribunal in passing of the impugned award dated 04.02.2020.

Hence, this writ petition stands dismissed.
