HON'BLE MR. JUSTICE INDERJEET SINGH Order 10/08/2021 Heard counsel for the petitioner. Counsel for the petitioner submitted that during the pendency of the execution proceedings before the Executing Court, the petitioner has made payment of its share to the respondent No.1. Counsel further submits that the State Government is also a party before the Executing Court and is liable to pay the remaining 70% of their share.

Counsel relied upon a judgment passed by the Division Bench of this Court in D.B. Civil Writ Petition No.15837/2018 titled as "Managing Committee & Ors. Vs. Yashpal & Anr." decided on 01.07.2019.

In that view of the matter, issue notice to the respondents, returnable by eight weeks.

Meanwhile, execution proceedings pending before the Executing Court shall remain stayed qua the petitioner.
