HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 06/08/2021 Learned counsel relies on the judgment passed by Supreme Court in case of Sameera Bano Vs. State of Rajasthan & Ors. reported in AIR 2007 Raj 168 and submits that a pre-election disqualification which has been pressed during previous tenure would not affect his present tenure in any manner and he cannot be ousted from the present post on the basis of findings relating to any misconduct prior to his being elected for the present tenure.
Issue notice of the writ petition as well as stay application, returnable within six weeks.
In the meanwhile, the effect and operation of order dated 10.02.2021 so far as it relates to the petitioner's present tenure shall remain stayed and the order dated 22.07.2021 shall also stayed.
