HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 06/08/2021 Issue notice of the writ petition as well as stay application, returnable within six weeks.
Learned counsel for the petitioners prays that protection be granted and the respondents be restrained from taking any coercive steps.
However, in the light of the judgment passed by the Supreme Court in the case of M/s. Neeharika Infrastructure Pvt. Ltd. Versus State of Maharashtra reported in AIR 2021 SC 1918, this Court refrains from passing any order of restraining the respondents from taking any coercive steps. The petitioner however, if deposits the amount, the same shall be kept in FDR and the petitioner would be entitled to get the amount recovered, if he ultimately succeeds in the present petition.
List the matter along with SBCWP Nos10222/2019, 3966/2017, 7841/2016, 4311/2016, 1803/2018, 4033/2017.
