HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 05/08/2021 Learned counsel for the petitioner submits that the petitioner has assailed the show cause notice dated 30.03.2020 in revision before the Joint Secretary (Mines) and the same is pending and no decision has been given by the authority. Learned counsel submits that vide the said show cause notice a huge sum of Rs.78 crore was demanded as against 1 acre Mine relating to masonry stone. Learned counsel submits that the said demand has been raised without holding the inspection report.
Learned counsel relies on the judgment passed in D.B. Special Appeal Writ No. 205/2021: Pradeep Kumar Versus State of Rajasthan & Ors. dated 09.07.2021 and order passed by Coordinate Bench in SBCWP No.1442/2020: M/s PNC Infratech Ltd. Versus State of Rajasthan & Ors. dated 06.07.2020 to submit that such penalty imposed was without inspection. Learned counsel submits that under the garb of pendency of the said revision, an order has been now issued cancelling the lease of the petitioner and now the respondents (Downloaded on 06/08/2021 at 10:11:26 PM) (2 of 2) [CW-7812/2021] may put the Mine for fresh auction which he assails in the present petition.
Issue notice of the writ petition as well as stay application, returnable within two weeks.
Notices be given 'dasti', as prayed.
In the meanwhile, the effect and operation of order dated 07.06.2021 shall remain stayed till further orders.
