HON'BLE MR. JUSTICE ARUN BHANSALI Order 26/08/2021 An application has been filed by the respondents alongwith affidavit of one Dharmpal, based on a power of attorney executed by other respondent in his favour inter-alia with a prayer that the parties have settled the dispute mutually, the appeal may be allowed in terms of the compromise.
As the prayer is for allowing the appeal, the appellant cannot have any objection.
Learned counsel for the respondents Mr. Rakesh Kumar Sinha reiterates the prayer as made in the application seeking that based on the compromise, the appeal be allowed.
In view of the submissions made, the application is allowed. The appeal filed by the appellant against judgment and decree dated 30.08.1990 passed by Additional District Judge, Nohar is allowed. The judgment and decree dated 30.08.1990 is set-aside.
No order as to costs.
