For the reasons stated, application seeking preponement of the date is allowed.
The matter is taken up for consideration today itself considering that the Civil Judge, Udaipur has initiated proceedings for sending officers of the petitioner-Nigam to civil jail. SBCWP No.5139/2019 In spite of service, nobody appears for the respondents. Admit.

(2 of 2) [CW-4691/2020] Meanwhile, effect and operation of the impugned judgment and award dated 17.09.2019 shall remain stayed, subject to condition that the respondent is taken back on duty. His appointment shall remain subject to ultimate decision of the present writ petition.
Needless to observe that as effect and operation of the impugned judgment and award has been stayed, the execution proceedings in relation to the award dated 17.09.2019 shall be kept in abeyance.
