JUSTICE DEVENDRA KACHHAWAHA Order 06/04/2021 Heard learned counsel for the appellant for condonation of delay in filing the appeal. The appeal is reported to be barred by 75 days. No reply has been filed to the application under Section 5 of the Limitation Act by the respondents. The application is not seriously opposed.
For the reasons mentioned in the application. The same is allowed. The delay in filing the present appeal of 75 days is condoned.
Defect No.2 regarding not filing of Vakalatnama be removed within three days.
Learned counsel for the appellant stated that appeal bearing No.1123/2018 has already been admitted on 14.01.2021 which is against the impugned judgment and award dated 09.08.2017. This appeal is also filed against the same impugned judgment and award, therefore, the same may also be admitted.
