that the petition may be allowed since the delay in filing the appeal is only one day.

In view of the above submission, this petition is allowed and the delay of one day in filing the appeal is condoned.

I.A. No.2 of 2023 Learned counsel for 1st respondent/plaintiff submits that if the petitioner/appellant deposits 50% of the decretal amount, he has no objection for granting stay. Learned counsel for petitioner/appellant agrees for this course.

In view of the above respective submissions, there shall be stay of operation of the decree and judgment dated 19.06.2023 in O.S. No.159 of 2014 on the file of V Additional District Judge, Tirupati, FAC X Additional District Judge, Tirupati, on the condition of the petitioner/appellant depositing 50% of the suit amount plus costs within six weeks from today, failing which, this order shall stand cancelled.
