The following is substantial question of law arisen for consideration.
a) Whether the judgment of the lower appellate Court is vitiated in ignoring to consider the ratio laid down in Anathula Sudhakar Vs P. Butchi Reddy, [AIR 2008 SC 2033].
______ SRS,J I.A. NO.1 OF 2022 This application is filed to suspend the judgment and decree dated 13.06.2022 in A.S. No.4 of 2021 on the file of the Senior Civil Judge, Tekkali. In this affidavit is filed in support of the petition. It was contended pending the suit.
Plaintiff filed I.A. No.3 of 2016 for ad interim injunction. The suit itself was dismissed by the Trial Court.
In the appeal no application was filed seeking injunction. The appellate Court granted injunction on 13.06.2022. Since there is a cloud covered the title, this Court is inclined to suspend the judgment and decree dated 13.06.2022.
