27-10-2022 DVSS, J Heard.

Learned Senior Counsel for the petitioner seeks interim direction for registration of sale deed which is kept pending. He points out the long history of litigation and the fact that the document in question has been executed by the III Additional District Judge, Guntur (since it is a suit for Specific performance) in the year 2013, itself. Learned Senior Counsel submits that since 2013, the document was kept pending. He points out that in the year 2016, a letter was apparently addressed by the Commissioner of Endowments to include the land in the prohibitory list stating that it belongs to the Endowments Department. Learned counsel relied upon the judgments enclosed in the material papers to argue that subsequent unilateral classification by the Commissioner of Endowments is incorrect and opposed the law and contrary to the judgments. Relying upon the Hon'ble Supreme Court judgment in Siri Nivasam mutual aided house building society limited and others vs. State of 2 Andhra Pradesh and others1 learned senior counsel also seeks an interim order.

At this stage, both the learned Government Pleaders for Revenue and Endowments seeks time to get instructions.
