Counsel for the appellants : Mr. G.Tuhin Kumar Counsel for respondent Nos. : Mr.Sita Ram Chaparla Mr.V.Surya Kiran Kumar (SC for VMRDA and MUDA) GP for Municipal Administration and Urban Development 2 ORAL JUDGMENT Dt:19.10.2022 (per Prashant Kumar Mishra, CJ) This appeal is filed against the order dated 27.01.2020 passed by the learned single Judge in W.P.No.1467 of 2020 directing the respondents therein to decide the representation of the petitioner dated 19.10.2019 in accordance with law.
2. Before operative portion of the order passed by the learned single Judge, it has been clearly observed that "though the petitioner made several allegations against the respondents, they are not required to be adjudicated by this Court".
3. In view of the above, since the writ Court has not decided anything, the same would not amount to Judgment appealable under clause 15 of the Letters Patent. Therefore, this writ appeal cannot be entertained and is liable to be dismissed.
4. At this stage, learned counsel for the appellants submits that the official respondents may be directed to afford an opportunity of hearing to the appellants before deciding the representation preferred by the writ petitioner/respondent No.1.
5. Considering the prayer made by the learned counsel for the appellants, it is directed that while deciding the representation of the writ petition, if the same is not already decided, respondent 3 Nos.2 and 3 shall provide an opportunity of hearing to all the parties including the appellants herein.
6. With the above observation, the writ appeal is dismissed. No costs. All pending miscellaneous applications shall stand closed. PRASHANT KUMAR MISHRA, CJ D.V.S.S. SOMAYAJULU, J Ksp
