                       Plaintiffs in the suit filed the above

                second       appeal   against      the    judgment    and

                decree, dated 13.06.2022 in A.S.No.154 of

                2009 on the file of II Additional District Judge,

                Visakhapatnam confirming the judgment and

                decree dated 20.03.2009 in O.S.No.98 of 1997

                on     the     file   of     Junior        Civil   Judge,

                Bheemunipatnam.

                       Plaintiff filed the suit seeking permanent

                injunction. Trial Court dismissed the suit.

                Aggrieved by the same, plaintiffs preferred

                A.S.No.154      of    2009    and        the   same   was

                dismissed confirming the judgment and decree

                in O.S.No.98 of 1997 against which the above

                second appeal is filed.

        The following substantial questions of

law arise for consideration:

      1) Whether judgments of the Courts below

        are   vitiated       in   not    considering        the

        undertaking          affidavit    filed      by     the

        defendant    in       I.A.No.555       of    2004    in

        O.S.No.98 of 1997?

      2) Whether judgments of the Courts below

        are vitiated in not properly appreciating

        Exs.A-10 and A-12?
