_____________________ B.S.BHANUMATHI.J I.A.No.2 of 2022 This petition is filed for stay of operation of the decree and judgment in MVOP.No.70 of 2016 dated 18.05.2022 on the file of Motor Accidents Claims Tribunal- cum-II Additional District Judge, Madanapalle pending disposal of the appeal. Learned counsel for the petitioner/ Contd., appellant/ respondent No.2 submitted that the impugned order is challenged on the grounds of contributory negligence and also that the doctor who issued disability certificate was not examined and the disability is not proved.
Since the hearing and disposal of appeal would take considerable time, it is a fit case to grant stay as prayed for on the condition that the appellant/respondent No.2 shall deposit 50% of the amount awarded together with proportionate interest and costs within eight (8) weeks from the date of this order. If the petitioner fails to comply the condition, interim order stands vacated.
