Dr. KMR,J & TRR, J The Special Sessions Judge-cum-IV Additional District and Sessions Judge, Guntur, has passed death sentence against the accused in Sessions Case No.85/S/2021, dated 29.04.202 and the same was sent to this Court for confirmation, vide R.T.No.1 of 2022.

The accused also filed Criminal Appeal No.190 of 2022 against the above said Judgment dated 29.04.2022 in Sessions Case No.85/S/2021.

As per proviso to Section 368 Cr.P.C., since the accused has filed an appeal, till disposal of the said appeal, confirmation order has to be deferred.

Accordingly, as the appeal filed by the accused is pending before this Court, the confirmation order is deferred till disposal of the appeal filed by the accused.

In view of the orders passed in R.T.No.1 of 2022, I.A.No.1 of 2022 filed in Crl.A.No.190 of 2022 shall stand dismissed.
