JUDGMENT:-
This Second Appeal is filed by the appellant being
aggrieved by the judgment, dated 17-10-2017 passed in
A.S.No.1 of 2009 by the Senior Civil Judge, Punganur whereby
and where-under the judgment and decree, dated 10-07-2008
passed in O.S.No.450 of 1991 by the Principal Junior Civil
Judge, Punganur was set aside.
2. When the matter is taken up for hearing, the learned
counsel for the appellant as well as the respondents conjointly
submitted that the parties have entered into the compromise and settled the matter out of the Court amicably and that the terms of compromise are reduced into writing in the form of memorandum of compromise and to that I.A.No.1 of 2022 has been filed seeking permission to record compromise and pass a decree accordingly.
3. The appellant as well as the respondents are present before this Court and had asserted the terms of compromise. Further, they have been identified by their respective counsel. 2
4. In view of the settlement arrived at between the parties, no purpose would be served in keeping the Second Appeal pending.
5. Accordingly, I.A.No.1 of 2022 is allowed permitting the parties to enter into compromise in terms of the compromise. Since I.A.No.1 of 2022 is allowed permitting the appellant and respondents to enter into compromise in term of compromise ( I.A.No.1 of 2022 ), this Second appeal is also allowed in terms of the compromise. Registry shall issue certified copy of this judgment along with certified copy of the joint compromise ( I.A.No.1 of 2022) filed in this Second Appeal.
Miscellaneous petitions, if any pending, shall stand closed.
