                         The Original Suit No. 34 of 2013 is filed by the plantiff

                   /appellant against the respondent/defendant for recovery of

an amount of Rs.1,43,866/- on the strength of promissory note was dismissed by the Trial Court on 23.12.2014 on the ground that plaintiff has not examined the attesters on the promissory note. The Appeal Suit No. 3 of 2015 filed by the plaintiff was also dismissed, against that Second Appeal No.328 of 2022 is filed.

The following are the substantial questions of law:

(1) Whether the judgments of the lower courts are vitiated in coming to the conclusion that non- examination of attester to prove exhibit A-1 and A-2 in suit promissory notes in the light of the judgment reported in 2006 (4) ALD 572?
(2) Whether the Judgments of the courts below are vitiated in ignoring to consider the presumption under Section 118(a) of the N.I.Act?
