ORDER:-

          This Writ Petition is filed under Article 226 of the Constitution of

India questioning notice issued by the 4th respondent in Rc.B.412/2022

dated 31.5.2022.

2. Learned counsel appearing for the petitioner submits that the 4th respondent has no authority to issue notice in Rc.B.412/2022 dated 31.5.2022, as per the observations made by the High Court in Ratnamma vs. The Revenue Divisional Officer, Dharmavaram, Ananthapur District and two others1.

3. Considering the above submission of the learned counsel for the petitioner, this Writ Petition is disposed of giving liberty to the petitioner to submit an explanation to the notice, under challenge in this petition, along with a copy of the abovementioned judgment, to the 4th respondent, within two weeks from the date of receipt of a copy of this order and on such, the 4th respondent is directed to consider the issue of his jurisdiction to issue such notice, before going into the merits of the case, and dispose of the same within four weeks thereafter.

Consequently, miscellaneous applications pending if any, shall stand closed.
