                   Special Judicial Magistrate of I Class (Excise)
                   Court, Eluru, W.G.District, submitted to this court
                   through the Registrar (Judicial), on record.
                           As      per      the        report,        the
                   accused/convict/petitioner     by   name      Nayudu
                   Venkata Nagesh, expired on 25.07.2019. Copy of
                   the death certificate is enclosed to the report.
                           The 1st respondent/State Bank of India,

Eluru filed complaint under Section 138 of the Negotiable Instruments Act against the petitioner, registered as Calendar Case No.467 of 2005 on the file of the Special Judicial Magistrate of I Class (Excise) Court, Eluru, W.G.District.

The learned court below convicted the petitioner/accused and sentenced to suffer simple imprisonment for four months.

In Criminal Appeal No.130 of 2006 filed by the petitioner, the learned Principal Sessions Judge, W.G., Eluru confirmed the conviction and sentence by judgment, dated 28.11.2006.

Challenging the appellate judgment, the present revision was filed.

No representation from the petitioner's side nor any application has been filed to bring on record the legal representatives of the deceased petitioner.

The finding of conviction against the petitioner stands as on today and consequently 2 SL. DATE ORDER OFFICE NO. NOTE the legal representatives, if any, need be given opportunity to prosecute the revision.

Sri Srinivas Challa, learned counsel, representing Sri K.B.Ramanna Dora, for the 1st respondent/Bank, as also Sri Soora Venkata Sainath, learned Spl.Asst.Public Prosecutor, for the 2nd respondent/State, shall get ascertained the legal representatives, if any, of the deceased petitioner and intimate the same to the court by filing requisite memo by the next date.
