AND THE HON'BLE JUSTICE Dr. V.R.K.KRUPA SAGAR CRIMINAL APPEAL No.198 of 2016 ADVANCE ORDER: (Per Hon'ble Sri Justice C.Praveen Kumar) In the result, the conviction and sentence recorded by the learned III Additional District & Sessions Judge, East Godavari District at Kakinada vide judgment, dated 31.12.2015, in Sessions Case No.2 of 2014 against the appellant/accused for the offence punishable under Section 302 I.P.C. are set aside. However, the appellant/accused is found guilty for the offence punishable under Section 304 Part - II I.P.C., and the sentence of imprisonment is reduced to the period already undergone. The appellant/accused shall be released forthwith, if he is not required in any other crime.
Accordingly, the Criminal Appeal is partly allowed.
