CRIMINAL REVISION CASE NO.690 OF 2009
ORDER:-
The request of Thajunnisa, learned counsel, representing
learned counsel for the petitioner, to file proof of service is
hereby rejected. The proceedings dated 22.11.2022 reflects the
state of affairs. The petitioner having challenged the Judgment
of the appellate Court in Crl.A.No.8 of 2007, under which the
learned appellate Judge confirmed the conviction imposed
against the petitioner under N.I Act and having got suspended
the sentence imposed against him did not show any interest to
show that notice be served on respondent No.2, who is the
complainant and whose presence is necessary before this Court for adjudication of this Criminal Revision Case. Inspite of specific conditional order dated 22.11.2022, the petitioner did not take notice to respondent No.2 as directed.
In the result, The Criminal Revision Case is dismissed for default. No costs.
Registry is directed to send the copy of this order along with the trial Court record, if any, to the Court below on or before 30.12.2022.
Consequently, miscellaneous applications pending, if any, shall stand closed.
