SECOND APPEAL No.966 OF 2016
ORDER:
01. O.S.1537 of 2005, is a suit for Partition. After due trial, the Suit was dismissed. Plaintiff preferred first Appeal in A.S.63 of 2012. After due contest, first Appellate Court agreed with the Judgment of the Trial Court and dismissed the Suit. The present Second Appeal is filed by the Plaintiff.
02. Learned counsel for the Appellant is in attendance and seeks permission to withdraw the Second Appeal. Notice on Respondent was served in this Appeal long time ago and none put in appearance.
03. In the result, this Second Appeal is dismissed as withdrawn. No order as to costs.
Consequently, miscellaneous petitions if any, stands closed. The interim stay if any granted is hereby vacated.
