Bench: M.Ganga Rao, V Srinivas
THE HON'BLE SRI JUSTICE M. GANGA RAO
                                       AND
THE HON'BLE SRI JUSTICE V. SRINIVAS
                              F.C.A.No.178 of 2007

JUDGMENT: [per Hon'ble Sri Justice M. Ganga Rao]

This appeal came to be filed by the appellant-respondent aggrieved by

the order dated 03.12.2007 in GOP.No.539 of 2003 on the file of the learned Judge, Family Court at Visakhapatnam, whereby the GOP filed by the respondent herein against the appellant, under Section 25 of the Guardian and Wards Act, for custody of the minor children viz., Sigala Venkatalakshmi and Sigala Vijay Kumar, was allowed.

At the hearing, learned counsel for the respondent submits that the minor children have now become majors and nothing survives for adjudication in the appeal.

A perusal of the record reflects that while admitting the appeal, this Court by order dated 23.01.2008 granted interim stay as prayed for. In that view of the matter and in view of the submission of learned counsel for the respondent that the children, the custody of whom is sought in the GOP have become majors, nothing survives for adjudication in this appeal.

Accordingly, the Family Court Appeal is dismissed as infructuous. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall also stand dismissed.
