Pending the Criminal Petition, I.A. No. 1 of 2022 came to be filed by Accused No. 5, seeking permission of the Court to compound the offence by compromise with Respondent No. 2.
Today when the matter is taken up for hearing, Sri. Gyary Nethala, learned Counsel appearing for the Respondent No. 1, identifies the Informant, [Smt. Kancharla Hamsamma, W/o.Venkateswar Rao], who is present in the Court. When examined, the Informant stated that she has no objection for closing of the case against the accused. She also states that, she lodged the complaint at the instance of her Son.
The Accused No. 5, who is working as Sub- Registrar, is present before the Court and is identified by the learned Counsel appearing for him.
As seen from the record, a crime came to be registered at the instance of the Informant for the offences punishable under Sections 120-B, 420, 463, 464, 465, 468, 471 & 506 I.P.C. and 81 & 82 of Registration Act. Total number of accused as per First Information Report are five [05] in number. The present application is filed only by Accused No. 5 seeking compounding of the offence.
A perusal of the First Information Report would show that most of the offences alleged are non-compoundable. Apart from that, the broader question that falls for consideration is, whether the investigation can be quashed by way of compounding the offence against only one accused when there are five accused in the case.
At this stage, the learned Counsel for the Petitioner/Accused No. 5 seeks time to place on record the judgments in support of his plea.
