                WRIT PETITION No.21466 of 2017

ORDER:

The writ petition is filed under Article 226 of the Constitution of India claiming the following relief:

"declaring the action of the 2nd respondent in issuing notice vide proceedings No. REV-ESEC (EVC)/106/2017-DYTAH (E6), dated 10.05.2017 proposing to take action in the representation of Mathukuvaripalle, Chandrasekhar Reddy of Mathukuvaripalle and other opponents, in spite of the judgment of this Hon'ble Court in W.P.No.26470 of 1998, dated 16.06.1999, is illegal, arbitrary and in violation of Articles 14, 19 and 21 of the Constitution of India and consequently quash the proceedings dated 10.05.2017 of the 2nd respondent."

2. Though the petitioners made several contentions regarding the validity of the notice No. REV-ESEC (EVC)/106/2017-DYTAH (E6), dated 10.05.2017, but the respondent filed counter along with proceedings of the Joint Collector in ROC.No.E4/802/2017, dated 19.06.2017, where the notice included in the writ petition is withdrawn as mentioned below:

"in pursuance of the orders of the Hon'ble High Court in W.P.No.23890/2017, dated 26.06.2018, further action on the show cause notice issued vide this office ref. Roc.E4/802/2017, dated 19.06.2017 for cancellation of DKT patta issued to Smt. K. Munemma (served on Sri K. Venkataramana Reddy, S/o. late Smt. Munemma) pertaining to the lands in S.No.57/3A, extent Ac.1.65 cents, S.No.280/1C Ac.0.25 cents, 280/2B extent 1.45 acres and 281/1 extent Ac.1.67 cents (total 5.02 acres) of Bodireddigaripalli Village vide DKT No. 19/4/1395, dated 25.9.1985 is hereby dropped."

3. In view of the order passed by the Joint Collector in ROC.No.E4/802/2017, dated 19.06.2017, no further adjudication is survives as mentioned in the notice itself is withdrawn.

4. Accordingly, the writ petition is dismissed as withdrawn. No costs.

As a sequel, interlocutory applications pending, if any, shall stand closed.
